Acceptance of Terms

By accessing or using the Blue Address platform ("Platform"), including our website, mobile applications, or any related services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and Blue Address Private Limited ("Company", "we", "our", or "us"). We reserve the right to update these Terms at any time, and continued use of the Platform constitutes acceptance of the revised Terms.

Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be barred from using our services under applicable law
• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials

We reserve the right to refuse service, terminate accounts, or cancel transactions at our sole discretion.

Account Registration & Responsibilities

When you create an account on our Platform:

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not transfer your account to any other person or entity
• You must provide accurate information and keep it updated
• One person may not maintain more than one account

Blue Address is not liable for any loss or damage arising from your failure to comply with these obligations.

Blue Address provides access to the following services:

Payments & Transactions

The following terms apply to all transactions made on our Platform:

• All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway
• Prices are displayed in Indian Rupees (INR) inclusive of applicable taxes
• Payment is required in full before access to paid content is granted
• We do not store your credit/debit card details on our servers
• Transaction records are maintained for legal and accounting compliance
• By making a payment, you confirm that you are authorized to use the payment method provided

Refund & Cancellation Policy

Given the nature of our digital services:

• All purchases of tender documents are final and non-refundable once access is granted
• If a technical error on our part prevents document access after payment, we will resolve the issue or issue a full refund within 7 business days
• Refund requests must be submitted to contact@blueaddress.com within 48 hours of the transaction
• Refunds, if applicable, will be credited to the original payment method within 5–7 business days
• We reserve the right to decline refund requests that do not meet the above criteria

For payment disputes, please contact us before initiating a chargeback with your bank.

Intellectual Property

All content on the Blue Address Platform is protected by intellectual property laws:

• All property listings, tender data, images, text, graphics, and logos are owned by or licensed to Blue Address Private Limited
• You may not reproduce, distribute, modify, or create derivative works without our written consent
• Tender documents purchased are for personal use only and may not be shared, resold, or redistributed
• Our trademarks and brand identity may not be used without prior written permission
• User-submitted content grants us a non-exclusive license to use it for platform operation

Prohibited Activities

Users are strictly prohibited from:

• Using the Platform for any unlawful or fraudulent purpose
• Attempting to gain unauthorized access to any part of the Platform or its systems
• Scraping, crawling, or data mining the Platform without written consent
• Sharing purchased tender documents with third parties
• Creating false accounts or impersonating other users
• Uploading malicious code, viruses, or harmful content
• Engaging in any activity that disrupts or interferes with Platform operations
• Using the Platform to harass, abuse, or harm other users

Violation of these prohibitions may result in immediate account termination and legal action.

Disclaimers & Limitation of Liability

Please read this section carefully:

• Property and tender information is provided for informational purposes only and does not constitute legal, financial, or investment advice
• We do not guarantee the accuracy, completeness, or timeliness of third-party tender data
• Blue Address is a technology platform and is not a real estate agent, broker, or financial advisor
• We are not liable for any loss arising from reliance on information displayed on the Platform
• Our total liability to you for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim
• We are not responsible for any indirect, incidental, or consequential damages

Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

Third-Party Services

Our Platform integrates with third-party services including:

• Razorpay — for secure payment processing (subject to Razorpay's Terms of Service)
• Cloudinary — for secure document and image storage
• Google Maps — for property location display (subject to Google's Terms of Service)
• Google Analytics — for platform usage analytics

We are not responsible for the practices or content of these third-party services. Their use is governed by their respective terms and privacy policies.

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate any of these Terms
• We reasonably suspect fraudulent or illegal activity
• Your account has been inactive for an extended period
• We are required to do so by law

You may also deactivate your account at any time through your dashboard settings. Upon termination, your right to access the Platform ceases immediately, but your payment records will be retained as required by law.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be:

• First attempted to be resolved through good-faith negotiation between the parties
• Subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India
• Governed by the Arbitration and Conciliation Act, 1996, if arbitration is mutually agreed upon

The place of arbitration, if applicable, shall be Mumbai, Maharashtra, India.

Changes to Terms

Blue Address reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a revised effective date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
